Terms of Service

1. About EatBuzz

EatBuzz is a school tiffin/meal subscription service operating in Kalyan, Maharashtra, India. We partner with FSSAI-registered kitchens and local vendors to deliver fresh, hygienic meals to your child's school during break time. The service is accessible via eatbuzz.in and via our WhatsApp ordering channel.

2. Eligibility

• You must be at least 18 years old and a parent or legal guardian of the child for whom you are ordering.
• The service is currently available only to families enrolled in our partner schools in Kalyan, Maharashtra.
• By creating an account you confirm that all information you provide is accurate and that you are authorised to agree to these Terms on behalf of your family.

3. Account Registration

Accounts are created using a mobile phone number verified by one-time password (OTP). You are responsible for:

• Keeping your OTP confidential and not sharing it with others.
• All activity that occurs under your account.
• Notifying us immediately at hello@eatbuzz.in if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently.

4. Orders & Delivery

4.1 Placing Orders

• Orders can be placed up to the daily cut-off time displayed on the order page. Orders placed after cut-off will be scheduled for the next available date.
• You can order for a single day or subscribe to a multi-day plan.
• Menu availability may vary by date and school. Seasonal or operational substitutions may occur; parents who have provided substitution consent will receive an equivalent meal of equal or greater value.

4.2 Delivery

• Meals are delivered directly to your child's classroom by our delivery staff at the scheduled break time (short break or long break, as selected).
• EatBuzz is not responsible for delays caused by school closures, unforeseen traffic conditions, or events beyond our reasonable control.
• If a school declares an unplanned holiday and we are not notified before preparation begins, a credit of the meal value will be added to your EatBuzz wallet.

4.3 Skipping & Cancellation

• You may skip a scheduled meal before the daily cut-off time; the amount paid will be credited back to your EatBuzz wallet.
• Cancellations after the cut-off time are not eligible for a refund unless caused by an error on our part.

5. Subscription Plans

• Subscription plans cover a fixed number of school days and are paid in advance. Unused days are not automatically refunded; contact us to discuss exceptions.
• Subscriptions are non-transferable to another child or school.
• EatBuzz reserves the right to modify plan pricing with at least 15 days' notice communicated via WhatsApp or in-app notification.

6. Payments

6.1 Payment Methods

We accept payments via the EatBuzz prepaid wallet (recharged using Razorpay UPI, net banking, or card), and direct Razorpay checkout for one-time orders.

6.2 EatBuzz Wallet

• Wallet balances do not expire.
• Wallet funds cannot be withdrawn as cash; they can only be used for EatBuzz orders. Exceptions are made at our sole discretion in case of service discontinuation.
• Wallet recharges are non-refundable once consumed against orders.

6.3 Pricing & Taxes

All prices are displayed inclusive of applicable GST. EatBuzz reserves the right to adjust prices at any time with reasonable notice.

6.4 Failed Payments

If a payment fails or is declined, your order will not be confirmed. Amounts temporarily held by your bank will be released per your bank's policy.

7. Refund Policy

• Refunds for eligible cancellations or service failures are credited to the EatBuzz wallet within 1 business day.
• Refund-to-source (bank/UPI) is not available in the current version of the platform; all refunds are wallet credits.
• In case of a meal quality complaint, please contact us within 4 hours of delivery at hello@eatbuzz.in with details. We will investigate and, if the complaint is substantiated, credit your wallet.
• Substituted meals (where the ordered item was unavailable and an equivalent was delivered with your prior consent) are not eligible for a refund.

8. Food Allergies & Dietary Requirements

While we take care to avoid common allergens, our kitchen handles nuts, dairy, gluten, and other allergenic ingredients. We cannot guarantee an allergen-free environment. If your child has a severe allergy, please consult our menu details carefully and contact us before placing any order. EatBuzz accepts no liability for allergic reactions arising from undisclosed allergen sensitivities.

9. WhatsApp Communication

By registering your phone number, you consent to receiving WhatsApp messages from EatBuzz via the Meta WhatsApp Business Platform, including order confirmations, dispatch alerts, and service updates. Message frequency depends on your order activity. You may opt out at any time by replying "STOP" or contacting us at hello@eatbuzz.in.

10. Intellectual Property

All content on the EatBuzz platform — including logos, images, text, and software — is owned by or licensed to EatBuzz and may not be reproduced, distributed, or used for commercial purposes without our prior written consent.

11. Prohibited Conduct

You agree not to:

• Use the platform for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorised access to our systems or another user's account.
• Submit false, misleading, or fraudulent information.
• Harass, abuse, or threaten our staff, vendors, or delivery personnel.
• Reverse-engineer or scrape any part of our platform.

Violations may result in immediate account suspension and, where appropriate, legal action.

12. Limitation of Liability

To the maximum extent permitted by applicable law, EatBuzz's total liability to you for any claim arising out of or related to these Terms or our service shall not exceed the amount you paid for the specific order(s) giving rise to the claim in the 30 days preceding the claim.

EatBuzz is not liable for indirect, incidental, consequential, or punitive damages, including loss of business, data, or profits.

13. Indemnification

You agree to indemnify and hold harmless EatBuzz and its operators from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service in violation of these Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising from these Terms will first be attempted to be resolved amicably. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Thane, Maharashtra, India.

15. Changes to These Terms

We may revise these Terms at any time. Material changes will be communicated via WhatsApp or in-app notification at least 7 days before taking effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
